Description

This book offers a thorough examination of intellectual property law, focusing specifically on copyright. It explores how intellectual property law recognizes and protects specific expressions of ideas, balancing various priorities in a pragmatic way. By granting exclusive private rights, the law aims to foster the sharing of ideas while deferring further development until the protection period expires. The book discusses the rights of creators, investors, and users, considering national interests and the promotion of trade through international, regional, and bilateral standards.

In the Malaysian context, intellectual property law is largely statutory, covering multiple forms of intellectual property with a robust body of case law supporting traditional areas such as copyright, trademarks, and patents. The book also addresses related areas such as contract law for rights transfer, and equity, tort, and criminal law for rights enforcement.

Designed as a comprehensive resource, this book is valuable for legal practitioners, students, educators, and policymakers. It provides an in-depth overview of legislative frameworks, recent case law, and various intellectual property forms in Malaysia. Legal professionals will find it useful for navigating the complexities of intellectual property law, while students and educators can use it as a foundational text. Policymakers will gain insights into how intellectual property laws can enhance trade and national interests.
