Possibly, courts may be convinced that the accused has committed the offence, but they are not in a position to convict him for dearth of legal and admissible evidence. A part from this the proliferation of cases involving scientific evidence brings to the courts new problems connected with the evaluation of such evidence. Basically, the problem relates to the fixing of standards for the admissibility of the expert evidence. Judiciary is very often depending upon”expert evidence” for arriving at a decision on matters adjudicated by it and their role in the administration of justice is increasing day by day. So far as complex and expert evidence is becoming increasingly significant as a component of criminal trial. So far as the Indian Judiciary should allow more and more scientific applications to enter into the legal fact-finding process, provided it is helpful to the legal system in determination of the facts in issue of a case in hand. The standard for admissibility of expert evidence is the central part of the modern criminal trial, especially for two reasons, viz. (i) Expert Evidence being more and more prevalent and significant; and (ii) It is also an area where admissibility may have more impact on the outcome of trial than any other type of evidence. Expert Evidence is fundamentally a vitalizer between science-law relationship and the inconsistencies if any are due to the approach of the discipline involved. The only issue ought to be who can elicit the truth, notwithstanding whether it is by an Expert of Judge. Equally, it is vital for the courts to adopt a standard of admissibility which ensures as much as possible that credible and only reliable piece of evidence is entering into the courtroom. So faras, judicial system must try to create good inter disciplinary relationship, particularly regarding expert evidence. We have done our best to bring all the relevant development of bar as have been taken in the field of law undertaken, very nicely and lucidly at one platform.
