Contracts and agreements are foundational to all spheres of society. The law has developed over the years to regulate and provide certainty in contractual transactions. In Malaysia, the principal applicable statute—the Contracts Act 1950—has largely remained as it was originally enacted, with only minor amendments. However, a significant body of case law exists which has applied and interpreted the statutory provisions to develop Malaysian contract law.

This book provides a comprehensive exposition of contract law through the lens of the Contracts Act 1950. This new edition captures the major developments in the law over the last 15 years since the publication of its first edition. During that period, Malaysian contract law has grown exponentially, particularly in recent years when the appellate courts have had the opportunity to consider and apply international developments emanating from the English courts and the courts of other Commonwealth jurisdictions.

About the Authors: 

Cheong May Fong is an Associate Professor at the Faculty of Law & Justice, UNSW Sydney and an Adjunct Professor at the Faculty of Law, Multimedia University. She was formerly Professor and Dean of the Faculty of Law, Universiti Malaya. She completed her PhD thesis on Unfair Contracts in Malaysia and has published widely in contracts, remedies, competition and consumer law, and gender equality. She currently teaches Contracts and Australian Consumer Law.
Choong Shaw Mei is a Senior Lecturer at the Faculty of Law, Universiti Malaya. She was formerly in law practice for about seven years, and was also Head of the Legal Department, Malayan Banking Bhd. She has published many articles on the latest developments in contract law and remedies in Malaysia and the United Kingdom. She currently teaches Remedies and Legal Drafting and also supervises student advisers at the Universiti Malaya Legal Clinic.
Yong Kai Jie practices law in Kuala Lumpur. He was admitted as an Advocate and Solicitor, High Court in Malaya in 2016. He lectures part-time at Multimedia University and Universiti Malaya on Land Law, Fintech and Blockchain. He is also a PhD (Laws) candidate at Multimedia University and is working on Smart Contract Codes as Contract Terms.
