I feel overwhelmed while presenting the Third Edition of this book captioned “Law of Defamation and Malicious Prosecution”. Defamation has assumed tremendous importance because it denotes the borderline of freedom of speech and expression as enshrined under Article 19(2) of the Constitution. A point for consideration in such cases always arises as upto what extent freedom of speech and expression is permissible and where defamation begins. In this edition some interesting cases on defamation have also been given e.g. in the case of R.P. Goenka v. State of UP, 2020 Cri LJ 1918 (SC) very lucid discussion is made on the statement made in a newspaper report. Likewise in the case of Mohd. Arshad Khan v. C.B.I., 2020 Cri LJ 1089 (SC) meaning of good faith has been made very elaborately clear In yet another case R. Rama Subramanian, 2021 Cri LJ 225 (Mad), where the allegation of defamation was made against the Chief Minister, the same could not be sustained and proceedings were quashed.
