A power of attorney is a useful legal document that allows an individual (donor) to appoint another person (done) to make decisions on various matters on behalf of the donor in a specific area, where the donor is unable to do so. This is a very important document for individuals to protect their interest. In Malaysia, it is common practice for landowners to create powers of attorney to the developer so that the developer can develop the lands, or for the elderly or those not in Malaysia, to create powers of attorney to their younger relatives, be it children or siblings, so that they can act on the donor’s behalf in relation to any dealings
relating to land or other interests.

About the Authors:
Nasser Hamid is the former Chief Editor of the Current Law Journal, Industrial Law Reports, Malaysian Tax Cases, the Managing Editor of the All-Malaysia Reports and the Journal of Crime. He was also the Editor of Info Alert and the Malaysian Law News.
He has authored 43 legal titles under the Sweet & Maxwell, Current Law Journal and Gavel Publications imprints. He currently practices law at Nasser Hamid & Associates, and has extensive experience in Civil Litigation, Strata Management, Industrial and Criminal matters.
Cheryl Nicholson
Graduating from the United Kingdom with an LLB (Hons) (Second Upper) degree in 1987. Cheryl went on to complete her Certificate in Legal Practice. She was admitted as an Advocate and Solicitor of the High Court of Malaya in 1989 and actively practiced as a litigation lawyer. During this time, she completed her Masters in Comparative Laws at the International Islamic University in 2006.
After a career in legal practice spanning 18 years, she left the profession and embarked into the academia arena joining Taylor’s University as a full-time lecturer with the School of Business and Law. In 2017, Cheryl retired from full-time teaching. She went on to become the Director/ Secretary of the Advocates & Solicitors Disciplinary Board, a position she held for a year before returning to teaching at Taylor’s University.
