Description
“Human rights” means the rights relating to life, liberty, equality and dignity of the individual guaranteed by the Constitution or embodied in the International Covenants and enforceable by Courts in India. The term Human Rights covers in its ambit those essential rights, defined or undefined which lead and contribute to the balanced development of Human Individual. The concept of Human Rights in modern times can be traced to Natural Law philosophers, who propounded these rights to protect Individual against the excesses of the state. However the International concern with Human Rights as enshrined in the U. N. Charter is not a modern innovation. It is in fact “Heir to all the great historic movements for man’s freedom to the enduring elements in the tradition of Natural Law and Natural Rights and in most of the worker’s great religious and philosophies and to the findings of contemporary science about inter relations of simple respect for human dignity and other community values. The concept of Human Rights represents an attempt to protect the individual from oppression and injustices. They provide a human standard of achievement for all the people and all the nations. These Rights are independent, inalienable and inviolable and hence universal. Protection of Human Rights in India is not only proclaimed by General Laws but also by the Constitution which is the Supreme Law of the land, because Human Rights are indispensable in the struggle against injustice and sufferings of the people. The Human Rights Protection Act which was enacted to protect the Rights of Citizens defines “Human Rights” as the Rights relating to life, liberty, equality and dignity of the individual guaranteed by the Constitution and embodied in the international covenants and enforceable by the Courts in India. Human Rights may be precisely defined as those minimal Rights which every individual must have by virtue of his being “a member of Human family” or as Rights that are inherent in our basic human nature and without which we cannot sustain as human beings. The protection of Human Right is gradually developing in India and now the concept has got enriched by encompassing many other Rights in it. Every care has been taken to incorporate each and every case and to eliminate any error or omission, but inspite of my best efforts, there might be some error or omission which I request to bring it to my notice so that it may be rectified in the next edition. It is, therefore, hoped that this book will continue to deserve the approbation of the Bench and the Bar then which there can be no higher reward for the author.
